In all cases if we do not inform you differently, the Terms of Use shall rule Your access to any of Our websites, services, software, apps, products, including without limits access to generated information and functions provided by KINGFOOTBALL or Third Parties.
2. When you access and use KINGFOOTBALL website, the KINGFOOTBALL app and/or any other KINGFOOTBALL Services, You agree to be legally bound by these Terms of Use (which might be changed with the time), and that shall form a legally binding agreement between You and Us.

“KINGFOOTBALL Content” - any content owned and generated by KINGFOOTBALL for which We take responsibility and to which we give access to Users via KINGFOOTBALL services.
“KINGFOOTBALL Services" - covers all services we provide via KINGFOOTBALL App, KINGFOOTBALL website or other services delivered by Our platform. All databases, features, software and web pages related to KINGFOOTBALL functionality, provided and defined by the company.
“KINGFOOTBALL Website” - means the official KINGFOOTBALL website available at www.KingFootball.com
Nature of the KINGFOOTBALL Services
1.KINGFOOTBALL is a mobile-first platform, which gives Customers the ability to create, publish, explore, scan, view and share mixed reality, augmented reality elements, including videos, as well as ability to track through blockchain technology the authenticity of digital facts and physical products through the KINGFOOTBALL Services.
2. By using KINGFOOTBALL Services you agree that the conditions of use may change occasionally without any notice given to You, including changing versions of the KINGFOOTBALL App, fixing bugs, and updating Our software stack. By using the KINGFOOTBALL Services you give us the right to install these updates automatically on your device.
3. At any time KINGFOOTBALL has the right to stop temporarily or permanently any of the KINGFOOTBALL Services at Our own discretion, without any prior notice to You. That may or may not include need for repairs, fixing of bugs, or any other need to reconstruct Our code or stack of technologies we use or other. We will always try to restore services as soon as it is reasonable to do so.
4. As discussed in the previous Clauses sometimes you might not be able to have access to the KINGFOOTBALL Services, including access to Your Content that is Generated by You. In some cases we might remove content, which violates Our Terms of Use. In other cases we keep the rights to remove Content at Our own discretion, for any reason, without notifying You in advance. In some cases any deleted Content Generated by Users or Third Parties may be stored by Us so we can comply with certain legal obligations and may not be able to retrieve it without a valid order from a Court. We strongly advise you to keep own backups of any content you might decide to generate. We shall not be liable in any way for alteration, discontinuance or change in the conditions of KINGFOOTBALL Services or loss of any data and content.
1. In cases Users have access to Third Party Content through KINGFOOTBALL Services, we shall act on behalf of the owner, and/or controller of any rights connected to that content, (a “Licensor”). The name of the licensor might be displayed on the pages of access, when a User is accessing such Third Party content.
2. By using the KINGFOOTBALL Services you confirm that You are fully aware that some of the Third Party Content might be subject to Intellectual Property Rights of the licensor or other parties. Any copying, modification, altering of similar work, rent, sell or distribution is not permitted unless permitted by the original owner, licensor, or by the controller of this Third Party Content.

In no case We can be held responsible for these Third Party Services, and We cannot provide approval, validation and feedback if these Third Party Services are fully compliant with regulations, have accurate content and are providing relevant information and truthful statements. If Users of KINGFOOTBALL services decide to use Third Party Services, they may do so on their sole discretion and at their own risk, and while visiting Third Party Services you might have to comply with new set of Terms of Use.
1. Some parts of the KINGFOOTBALL App or KINGFOOTBALL Website might display Third Party advertising and promotion. In these cases any company that acts as an advertiser and promoter shall be accountable for selecting proper content and information, which gets submitted and published on the KINGFOOTBALL Services and shall make sure that all uploaded, displayed content is in full compliance with laws and legal requirement. In cases of impreciseness or misleading information of Third Party advertiser or promoter, KINGFOOTBALL shall not be responsible in any way.

If You decide to act on any displayed information from Third Party advertiser or promoter, be it buying products or services, or subscribing, or any other action that involves business transaction or your participation, You shall be held personally responsible for making this choice and any decision of that kind shall be proceeded without the participation of KINGFOOTBALL and the latter shall not be responsible for any proceedings in such cases.
1. In no cases you may use the KINGFOOTBALL Service in order to breach a law, legislation or license that applies to You or your contracts with other party.
2. Communication and exchanges between You and other Users are Your responsibility. In some cases we might help but we are not obliged to help in the interaction between You and other Users.
3. You fully consent that you shall not use KINGFOOTBALL generated content, or Third Party Generated content on KINGFOOTBALL Services for any commercial goals without receiving written permission from Us to do so.
4. Any instructions that we may reasonably request for You to follow when using KINGFOOTBALL Services shall be complied with and you agree to this fully.
1. All User Generated Content by You shall be Your sole responsibility and you should be solely liable for any breaches stemming from these actions. The content might include but not be limited to artwork, video, music, photos, profiles, links, literature, animation, etc.
2. In case of breach of data protection laws or any other legislation when a User is generating Content the latter shall be held solely and fully responsible. KINGFOOTBALL obligates Users to exercise caution when disclosing and exchanging personal details of others as part of User Generated Content.
3. In some cases You participate in determining the purposes for which You collect, use and disclose content through the KINGFOOTBALL Services. You may be a ‘data controller’ for the purposes of GDPR in Europe. In cases wherever KINGFOOTBALL uses Your content for Our own functions, KINGFOOTBALL is going to be the joint information controller of Your content and wherever this can be the case, we are going to handle any personal information contained among the content in accordance with Our Privacy Policy.
4. You agree that when using the KINGFOOTBALL Services You shall not:
- use the KINGFOOTBALL Services in any malicious or aggressive way against other people and users of KINGFOOTBALL. This means you shall not insult, harass, threaten or torment anyone and you shall not disclose any personal information that may have such effects.
- use the KINGFOOTBALL Services to upload, post, promote, publish, store, distribute or link any harmful, infringing, unlawful, hateful, defamatory, threatening, vulgar or any kind of illegal material or anything that might constitute criminal offence or can trigger a litigation or court proceeding against Us or You.
- upload, post, promote, publish, store, distribute or link to nude, partially nude or sexually related photos or videos;
- compromise the rights of, bring harm to, or in any way unfairly deal with children or minors;
- encourage, incite and promote violent, exploitative, racist, discriminatory, socially unacceptable or irresponsible behaviour;
- reveal any confidential or sensitive information about third parties unless You are fully authorised to do so;
- connect any content to other material that consist Intellectual Property Right to any Third Party, or that breaches any privacy of third party without any received consent from You to do so;
- obstruct anyone else’s use or enjoyment of the KINGFOOTBALL Services, including sending messages, or posting on social media or emails with this purpose;
- link any content to software programs that are malicious and might contain viruses and are harmful to use and may damage in any way the workflow of KINGFOOTBALL Services;
- have multiple sign-ups;
- pretend to be someone else;
- promote any activity that is illegal;
- use software to collect information from the KINGFOOTBALL Services.
5. Any User Generated Content will not strictly be reviewed by KINGFOOTBALL or edited prior to its release on KINGFOOTBALL Services. However, in some cases KINGFOOTBALL may decide, without any obligation to do so, to review, remove and ban certain content that We find is in breach of Our Terms of Use and Privacy Policy or that might not be used for some time or We find is not relevant or might need to be removed due to normal support procedures in which cases Users do not have to be informed in advance.
Content might be accessed only with devices that are supported and cover minimum requirements. In some cases some functionalities (such as scanning NFCs) might not be available if your device does not cover these requirements (e.g. your device does not have NFC), thus limiting the full user experience and functionalities that you could otherwise enjoy. If this is the case and your device has no NFC, you may use the “Help a Friend” functionality within the KINGFOOTBALL App. The Operational System of device also matters. Devices to use with KINGFOOTBALL Services
All responsibility to possess relevant equipment in order to use the KINGFOOTBALL Services lies to the Users and You must ensure that unauthorized users are not accessing the KINGFOOTBALL Services without Your permission and consent. All damages incurring in cases of such breaches and unauthorized usage of KINGFOOTBALL Services shall be covered by You.
1. In the general case You shall be obliged to register to use the KINGFOOTBALL Services. There may be some information that you might need to provide in order to register. Even when using KINGFOOTBALL Services without registering you are still under the coverage of these Terms of Use.
2. In case of a registration process You may need to submit an email address, user name and password or social media profile all of which have to be verified by Us and these will be the email address, username and password, or social media profile that You will be required to submit each time You log in to use the relevant feature of the KINGFOOTBALL Services.
3. Whenever you provide us with details upon registration You must ensure that they are accurate and thorough. If any changes in the submitted information occur You must inform Us immediately so that we can communicate with You in an effective manner.
4. Users should keep their usernames and passwords private. We would presume that anyone who uses the KINGFOOTBALL Services from your account is either You or someone who acts on Your behalf. Please, have in mind that You will be held accountable for any activity performed with your account. Therefore, if You register any strange activity with Your account or if You suspect that anyone else is using Your account, You should inform us instantly. Respectively, we may ask You to change Your password or username.
5. We keep the right to refuse the register of a user.
1. KINGFOOTBALL is the only and exclusive owner of the KINGFOOTBALL logo and the KINGFOOTBALL Services. This KINGFOOTBALL App permits you to use the KINGFOOTBALL Services for mobile devices. Once you download the App to your Device and accept these Terms you may use the KINGFOOTBALL App and Services.
If you wish to use the KINGFOOTBALL App and the KINGFOOTBALL Services you must have also read and agreed to the KINGFOOTBALL Privacy Policy. A copy of this Privacy Policy can be found at Privacy Policy and in the KINGFOOTBALL mobile application
* The KINGFOOTBALL Logo is a trademark of KINGFOOTBALL that has been registered in the European Union and the United States of America and is in the process of being registered in other countries.
2. All other trademarks, graphics and logos used in within or in connection with the KINGFOOTBALL Services are unregistered or registered trademarks of other companies.
3. KINGFOOTBALL is not liable for Third Party Content or User Generated Content included in the KINGFOOTBALL Services.
4. We grant you a limited, single user, terminable, non–sub-licensable, royalty-free, non-transferable, non-exclusive license to install and use the KINGFOOTBALL App on any Device that you own. You may do this for your personal use in connection with using the KINGFOOTBALL Services and as permitted by the Apple Terms of Service or Google Terms of Service (as applicable).
5. This Agreement will also govern any software upgrades provided by KINGFOOTBALL that replace the original KINGFOOTBALL App, unless such upgrades are accompanied by a separate license and in this case the terms of this license will govern. All Intellectual Property Rights of the KINGFOOTBALL Services and all related Content and materials are owned by and shall remain owned by KINGFOOTBALL, subject to the following Terms of Use:
- You must not copy, reproduce, alter, modify or adapt all or any part of the App;
- You must not copy, reproduce, alter, modify or adapt all or any part of the Content;
- You may use the Content only for User’s personal and non-commercial purposes;
- You must not reproduce or use the Content without Our prior written consent;
- You must not sell or distribute the content to any third party
- You must not remove, alter or obscure any copyright, trademark or other proprietary rights contained in the Content;
- You should be aware that you may not be able to access certain items of Content due to territorial restrictions, which you may be subdue to.
- You must not carry out reverse engineering of the App or of any part of the Content
- You shall provide account information, which is true and accurate in every respect
- You will not use the App, directly or indirectly, for any fraudulent undertaking or in any manner so as to interfere with the functionality of the App.
6. We grant you the non-exclusive, non-transferable right to use Our App, including the copyright and all intellectual property rights therein, in connection with the App and in accordance with this Agreement. The App and all content derived from the App is protected by copyright and/or other intellectual property rights. You hereby acknowledge that by using the App you obtain no rights in the software, trademarks or content related to the App and you may only use the same in complete accordance with this Agreement.
7. You will retain all rights in Your User Generated Content in case you give KINGFOOTBALL the right to use, store, modify, delete, display, and distribute your User Generated Content. This shall be done only for the development, promotion, and support of KINGFOOTBALL and Our business in all media formats and through any or all media channels.
8. You are more than welcome to share ideas, suggestions and recommendations with Us with respect to the KINGFOOTBALL Services. In such case you shall remain the owner of the rights of the submitted ideas and related Intellectual Property Rights. However, by sharing your ideas, you will grant KINGFOOTBALL an unlimited, non-exclusive, royalty-free licence to use, copy, modify, distribute, sell, license, sub-license and transfer any of these rights to others. This means that KINGFOOTBALL will be free to exploit and use any ideas it receives from a User without having the obligation to provide financial compensation to the User.
1. The KINGFOOTBALL App has been developed with care and skill to provide a high quality of its Service. KINGFOOTBALL does not make any other promises or warranties about the KINGFOOTBALL App. We are not to warrant that we will provide uninterrupted or error-free use of the KINGFOOTBALL Services and We shall not be responsible for the completeness and reliability of any Content, especially Third Party Content and User Generated Content. Likewise, KINGFOOTBALL will not endorse and shall not be kept responsible or liable in any way for endorsement of any User generated Content. We are not to warrant that the KINGFOOTBALL App will operate free from errors, loss, interruptions, attack, interference or other security intrusion. You shall be responsible for keeping your profile secure and clean from viruses, worms, trojan horses and other harmful content. In this regard you should be careful whenever using the KINGFOOTBALL App in an unsecure or unkown environment.
2. All Services, materials and information provided by KINGFOOTBALL is provided on an “as is” basis without any further warranties.
3. In no event shall We or any of Our corporate affiliates and service providers be liable for any direct, indirect or consequential damages, or any other damages of any kind arising out of or in any way related to or connected with any use of the KINGFOOTBALL Services or the content contained in or accessed through this website. By downloading the app and using materials and information through the KINGFOOTBALL Services You accept that this shall be done at Your own discretion and risk and that You will be solely responsible for all outcomes that come as a result of Your usage including, but not limited to sharing of data, downloading and viewing visual materials.
All services within the KINGFOOTBALL App and Site are free of charge. However, KINGFOOTBALL is associated with the sites and services of its business and associate partners. If you wish to purchase or do purchase a product that has been referred within the KINGFOOTBALL App, this shall be done on the platforms of Our partners. KINGFOOTBALL shall not enter in any financial transactions and You shall not be requested any payments within any of the KINGFOOTBALL Services.
1. If you breach these Terms of Use, we may immediately terminate Your access to the KINGFOOTBALL Services, but all provisions of this Agreement will survive termination and continue in effect.

KINGFOOTBALL will not be held liable for the failure to perform its obligations under these Terms Of Use, if such failure is occasioned by a contingency beyond Our reasonable control, including any act of God without limitation, acts of war, labor difficulties, riots, fire, flood, hurricane, windstorm, governmental laws, delays in transportation or communications, acts or regulations (including the inability to obtain any necessary permits), or shortages of materials; provided, however, that such relief will only continue for so long as the force majeure condition exists.
The failure of KINGFOOTBALL to enforce any right or provision in these Terms Of Use shall not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing. Any waiver by KINGFOOTBALL to enforce any right or provision in these Terms Of Use shall not constitute a subsequent or future waiver of KINGFOOTBALL rights to enforce this Agreement to the fullest extent.
